1. Agreement to these terms
These Website Terms of Use ("Terms") govern your access to and use of the Elevate State website, forms, HPA and publicly available content (together, the "Site"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
The Site is operated by Elevate State Holding AB, organization number 559476-5512, registered address Lilla Håjumsgatan 2, 46135 Trollhättan, Sweden ("Elevate State", "we", "us" or "our"). Contact: leaders@elevate-state.com.
2. What the Site provides
The Site provides educational performance-development information and may provide access to the Human Performance Assessment™ (HPA), products, applications, consultations and other services. Availability, pricing, scope and eligibility may change. Nothing on the Site is an offer to provide a specific service unless we expressly state otherwise in writing.
3. No medical, psychological, legal, financial or professional advice
The Site, HPA and Human Performance Blueprint™ materials are educational performance-development resources. They do not diagnose, treat, cure, or prevent any disease, condition, or injury, and they do not replace qualified medical, psychological, mental health, legal, financial, or other professional advice or treatment. Always seek appropriate professional support for questions requiring it.
Do not use the Site in an emergency. If you believe you or another person may be at immediate risk, contact local emergency services or an appropriate crisis service.
4. The Human Performance Assessment™
The HPA is designed to help you reflect on current performance patterns and identify areas that may merit attention. It is not a clinical assessment and does not provide a diagnosis. Assessment outputs are not guarantees, predictions, or personalized professional advice.
You are responsible for deciding whether the HPA is appropriate for you and for how you use any information it provides. You should provide accurate information and avoid submitting sensitive information unless we clearly request it and provide the relevant consent or notice.
5. Eligibility and acceptable use
You must be at least 18 years old and capable of entering into a binding agreement to use paid services or submit an application. You agree not to misuse the Site, interfere with its security or operation, attempt unauthorized access, submit unlawful or infringing material, impersonate another person, or use the Site in a way that could harm Elevate State, its users or providers.
6. Purchases, applications and separate agreements
A purchase, application, inquiry, booking request, or completion of the HPA does not, by itself, create a client relationship or guarantee acceptance into any program. Private diagnostic or other personalized engagements are subject to our review for fit, availability, payment arrangements and any separate written client agreement or checkout terms supplied for that service.
If a separate agreement applies to a purchased service, that agreement will control to the extent it conflicts with these Terms.
7. Intellectual property
The Site and its content, including text, assessments, scoring methods, graphics, logos, videos, product names and materials, are owned by or licensed to Elevate State and are protected by applicable intellectual-property laws. Subject to these Terms, you may view the Site for your personal, non-commercial use. You may not copy, reproduce, modify, distribute, create derivative works from, publish, sell, license, reverse engineer or exploit content without our prior written permission, except where mandatory law allows it.
8. Third-party services and links
The Site may use or link to third-party platforms, including Kajabi, Typeform and payment providers. Those platforms are governed by their own terms and privacy practices. We are not responsible for third-party content, availability, acts or omissions.
9. Availability and changes
We may change, suspend or discontinue any part of the Site at any time. We do not guarantee that the Site will always be available, uninterrupted, secure or error-free. We may update these Terms by posting an updated version on the Site; continued use after the effective date constitutes your acceptance of the updated Terms.
10. Disclaimers and limitation of liability
To the fullest extent permitted by law, the Site and its content are provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory. We do not warrant that any information, assessment outcome or recommendation will be complete, accurate, suitable for your circumstances or lead to a particular result.
To the fullest extent permitted by law, Elevate State will not be liable for indirect, incidental, special, consequential or punitive losses, or for loss of profits, data, business opportunity or goodwill arising from use of, or inability to use, the Site. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory consumer rights.
11. Privacy
Our processing of personal data is explained in the Elevate State Privacy Policy at https://peakperformancemastery.mykajabi.com/privacy-policy. By using the Site, you acknowledge that policy.
12. Governing law and disputes
These Terms are governed by Swedish law. Any dispute will be submitted to the courts of Sweden, unless mandatory law gives you the right to bring the matter elsewhere. If you are a consumer, nothing in these Terms limits protections that cannot be waived under the law of your habitual residence.
